General Terms — Consumers

Terms applicable to consumer clients (B2C). For professional clients, see our B2B Terms.

Important: These terms apply to consumers (natural persons acting outside their professional activity). If you are a professional (company, self-employed, association acting in their business scope), please refer to our B2B General Terms.

2. Scope and services offered

VirtuSpace provides the following services to consumer clients:

  • Matterport 3D virtual tours of residential properties
  • Drone aerial photography and video
  • Social media content (reels, short videos, photos)

Services are described in detail on the website and confirmed in the quote sent to the Client.

3. Pre-contractual information

Before any order, VirtuSpace provides clear and understandable information regarding:

  • The essential characteristics of the services
  • The total price (no VAT applicable, franchise en base — Article 293 B CGI)
  • Delivery times and methods
  • The right of withdrawal and its conditions
  • Legal guarantees
  • Contact details for after-sales service

4. Order and conclusion of the contract

The contract is concluded once the Client accepts the quote in writing (electronic signature via the client area or written confirmation). VirtuSpace sends an order confirmation by email summarising the agreed services, price, and timing.

5. Prices and payment

Prices are stated in euros and include all applicable taxes. VirtuSpace benefits from the VAT franchise en base (Article 293 B CGI), therefore VAT is not applicable.

Payment terms:

  • 30% deposit upon order, payable by bank transfer within 14 days
  • 70% balance upon delivery of the services

No additional or hidden costs apply beyond what is specified in the quote.

6. Delivery

Services are delivered within the timeframe agreed in the quote, generally between 5 and 15 business days from the shooting date.

Delivery occurs by making the services available in the Client's secure online area (client area on virtu-space.com).

If delivery exceeds the agreed timeframe by more than 7 business days without justified cause (Article L216-2 of the Consumer Code), the Client may cancel the contract by registered letter with acknowledgement of receipt or by email at coorpvs@gmail.com, and obtain a full refund within 14 days.

7. Right of withdrawal — 14 days

In accordance with Articles L221-18 and following of the French Consumer Code, the Client has a period of 14 calendar days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their decision or pay any penalty.

7.1. How to exercise the right of withdrawal

To exercise this right, the Client must notify VirtuSpace of their decision to withdraw before the expiry of the 14-day period by means of an unambiguous statement, for example:

7.2. Refund

VirtuSpace will refund all amounts paid no later than 14 days from the day on which it is informed of the Client's decision to withdraw, using the same means of payment used for the initial transaction, unless the Client expressly agrees to a different method.

7.3. ⚠️ Important: Exception for services started with the Client's consent

In accordance with Article L221-25 of the Consumer Code, if the Client expressly requests the start of the service performance before the end of the withdrawal period, the Client acknowledges that:

  • If the service is fully performed before the end of the 14-day period, the Client loses the right of withdrawal;
  • If the service is partially performed, the Client remains liable to VirtuSpace for an amount proportional to what has been provided.

When booking the shooting date, the Client may be asked to explicitly waive their right of withdrawal if the shooting takes place within the 14-day period. This waiver is recorded in writing in the order confirmation.

7.4. Standard withdrawal form

8. Legal guarantee of conformity

VirtuSpace is bound by the legal guarantee of conformity (Articles L217-3 and following of the Consumer Code) and the warranty against hidden defects (Articles 1641 and following of the Civil Code).

The Client has a period of 2 years from the delivery of the service to act under the legal guarantee of conformity. They may choose between repair or replacement of the service, subject to the cost conditions provided for in Article L217-12 of the Consumer Code.

The Client is exempt from providing proof of the existence of the lack of conformity of the service during the 12 months following its delivery.

The legal guarantee of conformity applies independently of any commercial warranty granted by VirtuSpace.

9. Warranty against hidden defects

The Client may decide to invoke the warranty against hidden defects in the service sold within the meaning of Article 1641 of the Civil Code. In such case, the Client may choose between resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

VirtuSpace undertakes to respond within a maximum of 5 business days.

11. Consumer mediation

In accordance with Article L612-1 of the Consumer Code, VirtuSpace offers the Client, free of charge, the option to use a consumer mediator with a view to amicable resolution of any dispute opposing them, after having previously attempted to resolve it directly with VirtuSpace.

12. Force majeure

VirtuSpace cannot be held liable for the non-performance or delay in the performance of one of its obligations resulting from a case of force majeure within the meaning of Article 1218 of the Civil Code.

13. Personal data

The processing of personal data by VirtuSpace is described in our Privacy Policy.

14. Intellectual property

The deliverables (3D tours, photos, videos) produced by VirtuSpace are protected by copyright. The Client receives a non-exclusive right of use for the purpose stated in the quote (e.g.: real estate sale, online presentation). Any other use requires written authorisation from VirtuSpace.

15. Applicable law and jurisdiction

These GTCS are subject to French law. In the event of a dispute, the Client may bring the case before the court of their domicile or the court of the place of performance of the service, in accordance with Articles R631-3 and R631-4 of the Consumer Code.

16. Changes

VirtuSpace reserves the right to modify these GTCS at any time. The applicable version is the one in force at the time of the order.
